Democratic governments owe people's power, and the source of their government's power is the people. Therefore, people's participation is also considered as "the right of people to participate in governing affairs". People's participation in the administration of the country's affairs has levels of policymaking, supervision and implementation, each of which has specific requirements that must be paid attention to in executive and legislative matters. Due to the fact that legislation is effective in all three areas, people's participation in establishing laws and regulations becomes necessary. In the current research, it is an applied-developmental research and it deals with the descriptive method of content analysis and the processing of qualitative data that were collected by using the interview method. In this research, by examining and analyzing the constitution and stating the levels of public participation and the pathology of legal capacities, it looks for the requirements of public participation in the establishment of laws and regulations. Participation of all natural and legal persons in all issues, participation in three stages of problem-finding, drafting and review for approval, public hearing and soliciting opinions in all stages of legislation, applicability in order to provide public interests and goals of the Constitution and upstream documents, informing The stages of legislation in issues that create rights or duties and the obligation to prepare an attachment of popular opinions and respond to opinions in the stages of establishing laws and regulations are among the findings of this research.
